Terms of Sale

These terms cover every sale made by Crystalline Chemicals, whether you order at the counter, on WhatsApp, by phone or through this website. Placing an order means you accept them.

Prices and quotations

Prices shown on this site are counter prices in Kenyan shillings for the pack size stated, and they include VAT where VAT applies. Landed costs on imported surfactants and solvents move with the exchange rate and freight, so a price is confirmed at the point of order. A written quotation is valid for fourteen days unless it says otherwise; for tender and framework work we will hold a price for an agreed period in writing.

Payment

Counter sales are settled on collection by M-Pesa, bank transfer or cash. Deliveries are paid before dispatch unless a credit account has been agreed in advance. Institutional buyers ordering against a Local Purchase Order are invoiced on delivery with the standard settlement period noted on the invoice. An ETR receipt is issued on every sale.

Collection and delivery

Orders confirmed before 2pm on a working day are normally ready the same day for collection in Nairobi. Courier deliveries upcountry leave the same or next working day and transit time depends on the carrier and the town. Delivery charges are quoted before dispatch. Risk in the goods passes to you on collection, or on handover to the courier where we arrange carriage on your behalf.

Packaging, quantity and tolerance

Liquids are supplied in jerry cans, pails and drums; powders in bags and pails. Filled weights and volumes carry a small commercial tolerance in line with normal trade practice for the pack size concerned. Returnable drums, where offered, remain our property and a deposit applies.

Checking goods on receipt

Please check quantity, pack condition and grade before you sign or before you leave the counter. Shortages or damage must be reported within twenty-four hours of receipt with photographs of the packaging. Chemicals that have been opened, decanted, diluted or blended cannot be returned.

Returns

Unopened goods in original packaging may be returned within seven days of receipt where the material was supplied in error by us, at no cost to you. Returns for any other reason are at our discretion and may carry a restocking charge; carriage on such returns is for your account. Materials with a short shelf life, sodium hypochlorite, hydrogen peroxide and enzyme products, are not returnable once they have left our store.

Safety, handling and suitability

A current Safety Data Sheet is supplied with every chemical line and is available on request at any time. It is your responsibility to read it, to provide the right protective equipment to anyone handling the material, to store it correctly, and to satisfy yourself that the material suits your intended formulation and end use. Any formulation advice, guide or starter kit sheet we publish is given in good faith as general guidance; you remain responsible for testing and for the safety, labelling and legality of the finished product you sell.

Restricted materials

Some materials we stock are controlled or require care in handling. We may decline an order, ask for details of intended use, or require collection by a named person. We do not supply materials where the intended use appears unlawful or unsafe.

Liability

Our liability for any claim is limited to the invoice value of the material concerned. We are not liable for loss of profit, loss of production, spoiled batches or other indirect loss. Nothing in these terms limits any liability that cannot be limited under Kenyan law.

Governing law

These terms are governed by the laws of Kenya and disputes fall to the courts of Kenya. If something has gone wrong, talk to us first, most issues are settled the same week.
